Dear Sir, I had a sale agreement for purchasing a flat on the basis builder will register the project in RERA if required. when the RERA is being effective when i asked my builder he says project is excluded because 80% work is completed,when i asked for the completion certificate he says he does not have it yet. then i asked him to go for a extra addendum on previous sale agreement which he denied. 1. With regard to the clarification that was given with regard to “Ongoing Project” under the Press note dated 18/07/2017, Point No. (iii) which states that “ where all development works have been completed as per the Act and certified by competent agency and sales/lease deeds of 60 % of the apartments/houses/plots have been registered and executed” ; the Government has clarified the interpretation of competent agency to be the authority under the Section 190 of Karnataka Municipalities Act.

They have just completed 30-35% of project till now. Sir, Builders are asking buyers registering property without getting OC and approvals. They do not come under RERA. I request you to include all such projects which builders are forcing on customers and trying to beat the system and avoid coming under RERA. All projects for which OC is not obtained or applied must come under RERA. This will be of great help to buyers and we can hold developers accountable. Sir, For Newly Launched Projects Plan Sanctions will be approved first and we will start the project But Commencement Certificate we will get later, in this case Karnataka RERA Asks Mandatorily Commencement Certificate for RERA registration so which date we need to mention in the registration for start of the project either Commencement Certificate or Plan sanction date because Act says we need to register the project within 30 days from the start of the project.

Sir, after uploading all the documents on the website, the portal asks for accepting two conditions. Out of which one is Except Aadhar card number all other documents are accessible for public domain. Does the domain allow financial statements to public access? Because financial statements are private documents of the promoter and even ITR filed is not accessible for public. Hence please clarify regarding the documents which are accessible for public.

Sir, The list of projects on website for which registration applications have been received TILL DATE shows records of up to 31 July 2017 only. While the projects are being allowed to be uploaded even after 31 July, the list on the website is NOT updated. We will never know if our project has applied for registration or not. The contact phone no. of RERA authority does not provide any clarification or information. Emails sent on info.rera are not even acknowledged or replied. Pls do the needful.

Sir, The RERA-Karnataka website for filing complaints by public is not user friendly. It asks for respondent info which may not be readily available. There is no field for project name. Developer mobile no. is mandatory which is generally not known to customers. There is no provision for a feedback or suggestion by the public. It is not clear whether we can file complaint against an ongoing project which is not registered with RERA by the developer. Emails sent to info.rera are not replied.

Your appointment as a single member Regulatory Authority is against the provisions of section 20 (1) of RERD Act. Can I file online complaint if my developer has not registered the project with RERA. but it is still incomplete and development work going on. Builder says the project is exempted. He says he has applied for OC and therefore he is excluded. The possession is still not offered and lot of work pending. 95% payment already taken four years back promising possession in 2014 but still not done. How and where can we complain against non registration of an ongoing project by a developer? What if the developer has applied for OC in backdate in connivance with the BBMP officials? RERA website asks for name and mobile no. of developer. Most developers execute projects in the name of SPVs details of which are not known ro customer. Companies will not have a mobile no. 1. National Green Tribunal originally ordered projects to be 30 meters away from water bodies. Later they changed it to 75 meters. Projects which are in advanced stages have been stopped. I, believe the cases are Supreme Court. The delay in decision affects both Builder and Buyer. What happens to projects started prior to the 75 meters rule. 2. Why a Channel Partner has to get registered? CP brings in a client but Builder gets into a Sale Agreement and is responsible. CP cannot be liable .

As per the notification in official CREDAI website, it is mentioned that the builders can quote the cost of the apartments only as per the “Carpet Area”. However, builders are still quoting the cost as per Super Built-up Area. Is this expected to change ?
